Legal Question in Family Law in Iowa

daughter wants to live with me

My daughter is 14 and wants to live with me...how long does the process take? It will be June when I am home on leave that she goes and talks to a lawyer. I want her to start her new school at the begining of the year. Also I am deployed overseas...my husband has POA, can he continue things in my absence? Also could she just not go back? I am afraid what her dad may do when he knows she wants to live with me. He is prone to violence.

Re: daughter wants to live with me

First of all, from all of us here thank you for your service. I do not know how far in the process you are, but although the opinion of the child is important in deciding such things it is not always determinative. Litigating at long distance is difficult. You can get a fair amount done by affidavit if you can find an attorney who will tackle the logistics. I see you are from Knoxville. Have you contacted an attorney to handle this for you?
