Never married to fahter of child. What is the custody of my daughter

I gave birth to my daughter in Iowa. I was never married to her father although I got married to a different man while pregnant. There was a paternity test done and she was not my husband's. The biological father has been in and out of her life for the entire 5 years which I have proof of through the courts and Department of Human Services. I want to know does he have any rights to her? his name is not on her birth certificate only my name is. So does her Biological father have any rights to her or does my husband even though paternity established she was not his? I want to terminate the biological fathers rights. Is that possible and what is the easiest way of doing this. My own daughter told me she wanted nothing to do with her real father because he lies to her all the time and she is only 5. Please help me I am desperate to get this man out of her life.

Was tbere ever any custody and support agreement in place? If not he's her father and you can't toss him aside like a kleenex. The standard for terminating a person's parental rights is not easy to meet There is no easy way to do it. It's not a job for an amateur, be prepared to spend serious money in litigation.
