Dear Inquirer:

If you marry your girlfriend, she can petition you for a green card as an immediate relative. If you entered the US with a visa, or someone filed a petition for your green card status before April 30, 2001, we may file for your "adjustment of status" to green card in the US. If not, then you would only be able to obtain a green card through processing at a US Embassy or consulate outside the US. If you have been unlawfully present in the US, this could present a problem, as you could be barred from reentry for a period of up to ten years. There is a waiver application of this provision available, however, the process is complicated.

I recommend that you email [email protected] or visit www.hanlonlawgroup.com if you would like to schedule a confidential consultation to discuss this matter further.
