Legal Question in Employment Law in Iowa

Gave Notice of Resignation Then Fired

My employer fired me after I let them know I would be putting my home on the market and leaving the area. I told them I could not give them a date of my last day since it would depend on the sale of my home, but I let them now I would give at least a two week notice when the time came. Do I have any legal grounds to file an EEOC or can I sue them?

Re: Gave Notice of Resignation Then Fired

No, you have no basis for a wrongful termination.

You didn't tell them you were giving them two weeks' notice, you told them you were leaving at some point. You were being considerate, but what did you expect them to do? They had the ability to hire/fire at will, and having an employee who has announced that he is dead wood is not in their best interests. What they were telling you is that your position is immediately going to someone else, so long and thanks for the fish!

HOWEVER, you now have the ability to file for unemployment, because you've been fired. Do so, because it is your right, if you are eligible. If they were silly enough not to offer you a severance package, then so be it.
