Legal Question in Employment Law in Iowa

On Paid Leave and Starting Work Elsewhere

I currently work at Company A and hate my job. I have been contemplating quitting. If I quit I only get my vacation time, and not my earned sick time. If I go on approved medical leave I can use my sick time and then my vacation time and then quit when that runs out. A little unethical, I know, but here comes the real question. While I am on a paid medical leave from company A can I interview and start a new job at company B?

There is probably no express prohibition under federal law on you going to interview with another employer while out on medical leave. However, the need for medical leave (if its for yourself) under the FMLA is triggered by you having a "serious medical condition," I would not recommend taking actions which might cause the employer to, in the future, be left feeling as though you committed some sort of fraud.
