Legal Question in Medical Malpractice in Iowa

Statute of Limitation

In 1983 my son was born with a large gash on his face as a result of forceps being used during delivery. WE were never told that we could seek any medical help from the hospital. A few years ago someone told me about an incident similar to mine and they were told that they had until the childs 18th birthday or the minor had until they were 21 to seek compensation or treatment.I wrote to the hospital about 2 years ago and sent baby and recent pictures of my son. They wrote back saying that we had to have done something prior to his 10th birthday. IS THIS CORRECT??? I am now living in Arizona as is my son.

Re: Statute of Limitation

I need more information. It appears your son was born in IA and therefore IA statutes would apply. Here in Arizona, he can bring an action till his 20th birthday.
