Legal Question in Workers Comp in Iowa

Second opinion

I am a volunteer at our hospital. While volunteering I fell on the ice and injured my knee. I have had double hip replacement previously and am concerned that since the WC doctor hasn't physically looked at or touched my knee since the accident that I will do damage to my hips or my back. Am I entitled to a second opinion? The lady from the hospital as well as the doctor are extremely rude and don't seem to care.

Hello, I'm sorry to hear you fell on the ice. It's not clear from your statement whether you've previously been convered by a wc program for hip and back problems. I'm not sure why you would be covered by wc, as a volunteer. You may be seeing the doctor who treats the hospitals ee's under their wc program but that doesn't mean the hospital is required to treat your injury as if it were a workers' compensation covered injury. I doubt that it is covered under the wc program because you're not an ee. And if you're not covered under that program then there is no way legally to force them to provide a second opinion. If you have health insurance you can obtain another opinion from under that insurance plan. Happy holidays. Steve Lombardi
