Legal Question in Credit and Debt Law in Kansas

Family member loan

I loaned my daughter and son-in-law

$6000 during the course of their 6 year

marriage. They are now divorcing and

he lives in Mississippi. How do I collect

his part (half) of the loan? Can I file a

suit in the Kansas courts?

If you and your sonto be ex son-in-law both lived in Kansas when you made the loan, you may fiel suit in Kansas for collection o fthe loan. However, yo have two issues. First you will have to get him served in Mississippi. Secondly, he may not have an assets in Kansas. You may have to get yoru Kansas judgemnt (assuming you wil win) registered in Mississippi (assuming you can) to be able teh actaully collect any money from him. I am not registered in practice law in Mississippi. so I do not know how long their statute of limitations is, nor how yo might register a KS judgmetn there. Perhaps you should consult with a MS attorney before deciding how to proceed.
