Legal Question in Criminal Law in Kansas

Mci

I was at a party in Overland Park, people were drinking and everyone stopped once we noticed the police were outside. No one let them in so they waited outside until they got a search warrant for the house after 4hrs. When they came in they issued breathalizers and i wasnt told i blew anything and i was aloud to leave the house. A few days later i recieved a letter from the police department saying i must appear in court, it said i no one under the age of 21 may possess, consume, attempt to buy alcohol. So i dont know what this meens i am 18yrs old it would be great if you could reply. THANK YOU

Re: Mci

It appears you have been charged with Possession or Consumption of Alcohol by a Minor. They will attempt to prove this by saying you took a breath test which was positive for alcohol. If you admitted to drinking they will use that against you also. They also have to prove you consumed or possessed the alcohol in Overland Park. About the only way they can do this is if they say you admitted to them that you consumed or possessed in OP. It's also possible they will try to get some of the party-goers to rat out the other ones in exchange for a good deal in court.

I have handled MANY similar cases in OP, Leawood and other courts and have had success getting some dismissed and getting good resolutions on the others. If you and/or any of your friends would like to talk more to me about this, contact me at [email protected]
