Legal Question in Criminal Law in Kansas

meth/warrant laws

Warrant was served on address only. The house is my brothers girl friends. He has own residence.Warrant charged meth/manufacture of meth. Items seized listed ephedrine and blue liquid with white substance in bottom. My brother was only one arrested she was let go as she is low income with 3 children she was never charged. There were several people arrested around this county. He asked for a court appointed attorney which the court provided. He contacted the attorney and was told he could not represent him beausce of conflict of interest, he was representing the other individuals that were arrested. My brother told him he did not know the other parties and the publication in the local paper made it seem they were all arrested together. The attorney told him to go back to the court and request a new appointed lawyer he could not help him. This is a small rural area of kansas with limited legal help close can anyone tell me what to do and what rights he has?

Your brother needs to advise the court of the conflict. . .it does not matter whether your brother knows the other people charged w/him; what matters is that 1 attorney cannot represent conflicting interests; e.g., another person arrested on the same charge may be claiming your brother is guilty.
