Legal Question in Family Law in Kansas

child custody

i moved to las vegas recently and we went to kansas for the holidays. my girlfriend of 5.5 years and I got in a argument. she stayed. she wants to come back now a week and a half later. while she was gone I found pictures and messages on the home computer of her and a couple of different men having an online affair. She was scheduled to meet one of them apparently while there!! (must of been the reason for the fight.) Now keep in mind she doesn't know, I know, about her affair. To get custody of the kids will a letter saying the kids are mine (full custody) and notarized by a notary public after she signs be legal and hold up in a court of law? I think I can get her to do it. but I need to protect myself from furture events involving my children and myself.

You should get the letter but until you have a custody order, most police will take the children from you and give them to her mother because you have not established paternity, even if you are on the birth certificate. The letter will just be evidence the judge will consider in who to award custody but is not a slam dunk.

Further, you would need to put certain things in the letter to protect you that requires the knowledge of a good attorney practicing family law.
