Want to move out of state with son

I have shared custody of my daughter from my second marriage and sole custody of my son from my first marriage. I want to move back to my home state of Massachusetts where my family is and take both of my children. I won't have a problem taking my son, but may with my daughter because her father lives here. I have an opportunity to make a significant amount of money in my home state (more than here in KS) and will have my family to help me raise my children. In addition, my son's father and family is in MA. I also want to leave because my daughter's father is still trying to control me by manipulating her. Can I leave?

You indicated that you have joint custody of the children, i'm assuming you also are the residential parent of each of your children. Most KS courts realize our society is a mobile one, however, you must Petition the court prior to such a move to determine whether the move is in the best interest of your children if their father is in disagreement w/the move. Even if he agrees to the move, it should be documented in a Petition and approved by the court holding jurisdiction of the children before you make the move.
