Termination for Gross Misconduct

In updating our Personnel Policies, we came upon a question regarding Termination for Gross Misconduct. The question is, can our agency refuse to pay accrued vacation and/or sick leave upon termination. Gross misconduct is defined as stealing, discrimination, sexual harrassment, unauthorized possession of drugs, narcotics or intoxicant, weapons, under the influence of drugs or alcohol, etc. Fraudulent statements on employment applications and disorderly conduct. Our agency is a non-profit childcare center.

Re: Termination for Gross Misconduct

The agency cannot refuse your earned wages or sick leave unless you owe the agency money - i.e., if you stole from them or had outstanding advances.
