Legal Question in Workers Comp in Kansas

Release of records, not work related

I hurt my left knee at work, torn meniscus, had WC paid by WC. Still having pain after 3 months. I have arrhtitis of right knee, but my left knee was my good knee. Now WC wants all my records from my doctor who treats my right knee. How far back can they request medical records for non work related problem?

THe insurance carrier defending your employer against your claim can get a lifetime of medical records if it wants. Your prior conditions and treatment can always be an issue. They may want to argue that your right knee pain is arthritic, not the result of the injury.

If you don't have an attorney representing you, I suggest you get one soon. The Insurance company is not there to help you.
