Legal Question in Criminal Law in Kentucky

Expunge Criminal Record

I would like to know if it is possible to have older criminal records expunged? If so, how do I go about starting the process? I have two assault 4th charges on my record. In both cases I could have, and still can prove that I did nothing wrong. I did not have an attorney at the time and didn't know that when I agreed to pay court costs I was pleading guilty. I had no idea these were on my record until I ran a criminal history check on myself. I am a law enforcement major and I am having trouble finding a job in that field because of this record. I would like to know what, if any options I have on this subject.

Thank you for your time,

MC.

Re: Expunge Criminal Record

KRS 431.078 allows for expungement of a prior misdemeanor conviction. Must be more than 5 years after completion of the sentence and must be done in the court where the conviction was ordered.

Re: Expunge Criminal Record

The answer to your question is yes. I would start by hiring counsel. If you are unable to hire counsel then contact the Legal Services Organization that serves your county. If you decide to do neither then contact the Court Clerkin in your county.
