abandonment

Do I have to have my son's father sign over his legal rights for my husband to adopt him? His biological father hasn't seen him in about 7 years and the only time I get child support is when it is taken from his annual tax return. Couldn't he just lose his rights due to abandonment?

Your husband may be able to adopt your child in a contested adoption proceeding. Since there has been no contact and your ex is behind on child support, your ex may not fight it as it will terminate his child support obligation and even if he does, it will be difficult for him to explain his absence.
