custody

how does a non-custodial parent gain custody of his child when that child lives in another state and the grandparents have custody of the child? The parents were never married. The grandparents are now very ill, and hospitalized and might not live. One of the grandparents is still in moderately good health, but the other one is in very, very grave condition.

Re: custody

I assume that the child and grandparents are in KY.

I further assume that the court order granting

custody to parents is from a KY court. Based

on these assumptions, a petition would need to

be filed in the court which granted custody.

In brief, it would have to show why a change of

custody is in the child's best interest, and that

circumstances since the order have changed so

dramatically as to warrant the court's holding

hearings to determine future custody.
