Legal Question in Family Law in Kentucky

Legal Separation changes before divorce

I am legally separated. Settlement had husband refinanacing house in his name only which he has done, but my name is still on deed. My lawyer did not advise me to look what the house was worth or the equity so I accepted an amount from the refinancing. I've since found out the house is worth much more than what I received. When I file for divorce can this be re-examined or is there no change to a legal separation agreement going into a divorce? The agreement only states he will refinance and pay me this amount. The separation was signed by the clerk in December 2008 therefore I can not file for divorce until 2009. If there is a chance to correct this I don't want to make another mistake. Thank you very much.

Re: Legal Separation changes before divorce

Generally speaking there would be no changes, however, if you can show the agreement was unconscionable, you may have an argument. You should speak to an attorney about this matter.
