Legal Question in Insurance Law in Kentucky

My husbands group health ins. covered him and my two children. ( I have my own at work). My son is 22 in college. We paid premiums up until Feb. 2007. We rec'd a request for full time college status for our son before they would pay an Oct. 2006 doctor bill. He had changed from full time to part time in August 2006. Therefore, they did not pay the oct. 06 bill. Also, they sent us a letter March 23, 2007 stating they were cancelling his poilcy backdated to May 2006. We now owe a 2700.00 bill to the insurance co. for medicine that was purchased in July 06. Are they required to give a notice when cancelling and can they backdate the cancellation? We have yet to receive any premiums we paid on behalf of our son May 06-Feb07. Our son had planned on being full time until August 06 when he returned to college. Thank you!!

I am afraid that these questions are impossible to answer without reading the coverage policy which you purchased. Usually, insurance companies write their policies in such a way that they can do most anything they want and you can do very little, but then courts often intercede to lessen the brutal effects of such contracts.

Aside from taking your policy to a lawyer, you can write a complaint to the Kentucky Department of Insurance at http://doi.ppr.ky.gov/kentucky/.
