Legal Question in Real Estate Law in Kentucky

Sewer line crossing neighbors property

I purchased a home 15 years ago. Recently I found our sewer line crosses the neighboring property to hook up to city sewer. There is no mention of the line on any deed I can find. The neighboring property owner has asked me to move the line at a cost of around $1000. Am I required to move the line and who pays.

Re: Sewer line crossing neighbors property

Issues involving property can get complicated. With the information you provided I cannot say if the sewer line must be moved, or if it is moved, who will have to pay. Your neighbor may have granted an easement for the running of the sewer line. This information is recorded with other deed information in your County. I suggest consulting an attorney in your area with experience with property/real estate law in order to protect your rights--now and into the future should you want to sell your home and move. Good luck.
