waiting for approval and leaving the country for a few days

I have to leave the country 04/15 and be back on 04/26. I need to know if the builder can sell the house while I'm outside of the country?

I'm buying a house through FHA loan and I'm waiting for its approval. The builder wants to close ASAP but the house is not 100% finished yet.

The builder is also late and they owe $50 per day after May 1st. (which is the due date of the contract)

If you have the builder under contract and you have met your obligations, he should not be able to sell the house. Your contract should have specific provisions regarding when the sale should be completed. Without seeing the agreement between you and the builder, it would be hard to give a more specific answer. If there is no written agreement, then get one or he can sell it to whomever he pleases.
