Legal Question in Wills and Trusts in Kentucky

How to Obtain a Copy of a Will

My father passed away a month ago. He was remarried to a woman who did not like his children. He told me I was left a large sum of money, but I don't know how to find out its location. I asked her for a copy of his Will, she told me I had no right to a copy and that she had had the Will changed. Her son was the executor and he is going along with her. My question is: ''How do I handle this situation and how do I find out where the money is? I'm in a wheelchair and I know that my Dad would want me to have what is rightfully mine. Any help you can give me would be greatfully appreciated.

Re: How to Obtain a Copy of a Will

If your father's will was probated in Ky, you, as an heir are entitled to notice. If the will is probated, it is then public record and can be obtained by anyone by contacting the District Court Clerk where the will is probated. Your father does not have to leave you anything as long as he was in his right mind at the time and was not under "undue influence". That is not to say that he was not influenced to leave property in some way just that it not be "undue" influence, that is that his ablility to follow his own wishes was substituted by someone's else's wishes. This gets more complicated. At the very least, you can get a copy of the will. It is probated in the county where he lived. Look in the phone book for the District Court Clerk or contact someone at the County Courthouse and they will tell you how to contact the clerk. Then, seek advice of local counsel.
