Legal Question in Criminal Law in Louisiana

Obtaining Refund of Bail money

If a case was dropped or failed to prosecute, how do you go about obtaining bail money refund? Person was jailed for looting and resisting arrest, but the case was dropped/charges dropped. How can that person get their money back?

Thank you.

Re: Obtaining Refund of Bail money

Dear Friend,

Sorry no one has answered your question to date. Let me check the Louisiana Code of Criminal Procedure and find you an answer. I would be interested in knowing whether you posted actual cash for a bond, or did you pay a professional bailbondsperson a "premium", usually 12%, to post a bond for you. If you paid a bondsman, then you do not get that money back, no matter what happened. If you put up cash, you are entitled to your money back. Of course, the sheriff probably put your money out to interest and he will keep the interest, unless you make him pay the interst to you. If I can help, call me! No charge for just talking! Keep up the good work!

Sincerely,
