Can you be arrested for a DWI if you are not in the vehicle when the officer arrives? Example; Someone outside the vehicle when the officer arrives hooking that vehicle to a tow truck to be moved. When the office ask who was the driver of the vehicle and one answers yes -- can that person be arrested for a DWI? All breath tests were denied.

Yes they can arrest you. Taht does not mean that they can convict you.
There are defenses to this DWI and I suggest you contact a very knowledgeable lawyer.
