Can my ex take my house?

i recently moved to Kentucky with my son. I have domiciliary custody of him, thru the court. But, my mother loaned me the money to buy a home here in Ky, and she holds the mortgage on the loan. I am in arrearage on child support payments; can she hold me in contempt and take the house?

I am totally confused by your email. Why are you paying child support? How can your mother hold you in contempt of court? If you are behind on your mortgage, you can be foreclosed upon.

The mortgage issue issue should be analyzed separately from the child custody issue.

If you are in default under the terms your mortgage, the holder of the mortgage could foreclose on the house.

The child support issue is independent. If you owe child support to your ex, she could bring an action in court to hold you in contempt. Whether she will do this or not is a separate question.

While this is issue is unrelated to your mortgage, contempt can be punished by jail time.
