purchases when married

I am planning to leave my husband, and I have received an offer to buy the home I am curently renting. How can I purchase the home under my name only to assure there will be no problems with community property laws? Would a legal seperation be needed prior to the contract agreement?

When you file for a divorce, that date is used to determine when the community regime ended, only if a final divorce is obtained.

As long as you purchase the home after you file for divorce, with your own money (not community money, including your own wages), and follow through with the divorce, your husband should have no claim to the house.

You must make sure you do not use community funds to purchase the home, it must be purchased after you file for divorce, and you must follow through with the divorce.
