Legal Question in Family Law in Louisiana

taking my children with me

If I leave my husband is it legal for me to take my three children with me. If so, can I stop him from possibly taking them from me, like checking them out from school or something. (There is no legal seperation filed.)

You can take your children but you need an order naming you domiciliary parent, or he has the same rights as yours. Unless the children are in danger if he has them, you will have to file paperwork and have a court hearing to get the order needed. There is no longer legal separations in Louisiana. By-the-way, you can file for a divorce while still living together.
