Legal Question in Civil Litigation in Louisiana
My neighbor has a large old live oak tree with a huge branch over my home (about 10 ' in height over the roof. If this branch falls on my roof will he be liable for the damage?

If it is encroaching on your residence, it can be trimmed and he can be forced to pay for it. If it merely hangs over the property line, then he is only liable if there is an obvious defect and he fails to correct it.
