Re: IS there a time limit on ''Last Checks''?

Louisiana law provides that an employer must pay you all earned wages after your termination or resignation "on or before your next regular payday" or no later than 15 days after your termination or resignation. So, the answer to your questions is "maybe." If you were terminated on a Thursday and your regular payday is Friday, then your employer would be required to pay you the next day. However, if you were fired on a Monday and your regular payday was Friday, he would have until Friday. The latest your employer has to pay you is 15 days. If your employer doesn't pay all your earned wages (which includes earned vacation, bonuses, commissions, etc.), then you may be entitled to penalty wages and attorney's fees as well. I hope this helps.

You should receive your final pay for "wages" on the next pay day following your termination. If they have not been received, you must make a FORMAL demand for payment (certified mail is one way) and those must be paid within 3 days of the demand. Failure to pay all undisputed wages opens them up to penalties of a maximum of 90 days wages and attorney fees. Remember that unused vacation, and vacation earned for next year are considered wages.
