Legal Question in Wills and Trusts in Louisiana

Succession without a lawyer

My Mom died recently. There are three heirs. We are all in agreement about division of any personal assetts she had, no debts are owed except on her home, which we want to sell. An attorney is an expense we would rather avoid, can we file a succession without hiring an attorney?

Re: Succession without a lawyer

Dividing the personal propert shouldn't be a problem as long as everyone can agree on who gets what. I would suggest making an inventory, deciding (by whatever means) who will get which items of personal property, and haveing each person sign a receipt for what they received.

Selling the house is another matter. A succession will have to be opened and the house sold by the individual heirs or by a succession representative. This has to be done by the book to make sure that the purchaser receives a clear title.

If the house is the only asset the attorney has to deal with, it shouldn't be an expensive process.
