My mother left land and a house to my brother and me equally. He wants to move into the house. Can I force him to pay me half of the appraised value of the house in order to take over the house? I have offered to do the same for him, but he wants the house without paying me anything.

To answer your question I will make the following assumptions: (1) Your father is deceased, (2) You and your brother are adults, (3) the debts owed by your mother have been paid, (4) and that you have not contacted a lawyer regarding any type of probate action.

With these assumptions, the answer to your question is that will be that you can force a partition which will result in the sale of the property wherein the net proceeds will be divided between you and your brother. However, you most likely will need to see an attorney to get all of that done.
