Legal Question in Family Law in Maine

Modifying final divorce and how long do I have?

Ex-husband resides and filed in Maine; finalized @ Feb 04; we had seperated Dec 98 and I moved to TN where I have lived since. He is active duty Army and retires Aug 05. The decree stated he would provide medical ins thru TRICARE but recently found I'm not covered nor would have even been eligible under current military rules. Decree also shows I would not pursue rights to a % of his retirement pension.

Can I amend or modify this decree and pursue the retirement which will allow me to purchase my own insurance? And can I do this from TN? My current employer does not offer insurance.

Re: Modifying final divorce and how long do I have?

There are several ways to modify the final decree. To file a modification petition in the court where the divorce took place; or file a motion to have the order registered in Tennessee and ask a Tenn. court to modify enforce and modify it. Getting the court to modify the portion of the final order grantings you 0% in the retirement will almost be impossible to do.
