Legal Question in Personal Injury in Maine

accessing confidential medical records

I accessed a former co-workers medical records through EMR. The content of the notes involved treatment for substance abuse and PTSS. While I never disclosed the context of the notes I reviewed, a case loomes that I inflicted emotional distress.

Re: accessing confidential medical records

You did not ask a question. However, for the sake of giving you a response, I anticipate that you are asking if the co-worker has a valid claim against you for infliction of emotional distress. I do not know all the facts, but based upon what you have stated, they may have a valid claim. Let me know if I may be of assistance in your defense of this claim. Thank you.
