Legal Question in Real Estate Law in Maine

Adjacent landowner encroaching on my property

A person who owns an empty lot next to my house lot began clearing an ATV trail through his lot to access a clearing he created next to a brook. He began this in 2004. He cleared trees and brush next to the brook, which is a protected area. I suspected he was encroaching on my land but since it is mainly wooded, it was unclear where the property line was. I could not find the property marker. I hired a surveyor and his results show that the landowner is encroaching on my land by about 20-30 feet. He has set up a shack on my property and also has tools and a small trailer on my land. The shack is not habitable, it's likely a storage building. I want him to cease any more tree cutting on my land and also remove his personal property from my land. It was suggested I send him a certified letter to that effect, I would just like any additional input. Thank you for your time.

Re: Adjacent landowner encroaching on my property

I would not tell him to stop trespassing on your land and include a copy of the survey and stress that he does not have permission to be on your land.
