Legal Question in Real Estate Law in Maine

Real Estate

When you have an agreement to build a modular home with a builder and you have received an estimate, they have built the house and then they tell you that you owe an additional $20,000. are you legally bound to pay this even though you have signed no additional paperwork? Should I get a lawyer and start suit?

Re: Real Estate

You should gather up all of the paperwork and meet with a lawyer. There is a statute in Maine called the "Home Construction Contract Act" that requires the initial contract to meet certain requirements, and also requires that any extra costs (known as change orders) are in writing and be approved, and it sounds like your change orders are not.

This does not necessarily mean that you do not have to pay for any of this extra work, but you may not have to pay for all of it.
