Bogus Employee 1099

Son's roommate's father created bogus 1099 stating son made a full-time income at his family owned jewelry store in order to not be co-signor on son's apartment rental lease. I know son did not pay taxes on bogus 1099 because he is actually a waiter. Is this illegal?

The Landlord certainly as defrauded in that the son and his father made a material misrepresentation of fact which the Landlord relied upon. Having said that, this would be a civil matter between the Landlord and the son and his father. Moreover, if the son actually pays all of the rent, the Landlord will have no damages to claims, and hence will probably not have a case to bring.

It is a violation of Federal Criminal Law to use the IRS forms in that fashion. That would be a matter for the IRS and the U.S. Department of Justice to handle. In related fashion, to the extent that the forms make representations related to state wages/taxes etc. it may violate criminal provisions of State Law as well.
