Legal Question in Civil Rights Law in Maryland

employment investigations

to what degree, or how far can an employer go when doing a security investigation for

employment on a potential employee? Does the degree of investigation extends even

further if the employee is hired? Would a employer go as far as home surveillance, or

is that just in the movies (The Firm)? thanks

Re: employment investigations

A prospective employer can use such methods and to such a degree as it deems necessary in doing a background check, so long as it does not infringe upon any legal rights of the employee. Usually background [hiring] checks are concluded when the employee is hired. Home surveillance is not typically done except in the movies, as it is quite expensive and runs the risk of invading the potential employee's right to privacy.
