Possibly. If the court entered probaton before judgement and three years have passed, then you may petition for expungement. If your lawyer filed a motion for modification and reduction of sentence to be held sub curia, then you may ask for a hearing and ask for pbj at the hearing. If no motion was filed, and if your lawyer failed to advise you about it, then you could petition for coram nobis, seek the opportunity to file a belated motion, and then seek pbj.

All of this, except the first one, is easier said than done. Coram nobis involves significant research to determine whether the record is sufficient to make filing worth pursuing. I offer a free initial consultation.
