do i need a lawyer for 2nd degree assulat if the plaintiff is not pressing charges

It is always a good idea to bring a lawyer to court, just in case the "victim" decides to change their mind. Also, if they come to court thinking they are going to "drop the charges", they can potentially be compelled to testify against you. The State's Attorney makes the decision on whether to prosecute cases. You should at least consult with a lawyer to assess your particular situation.

Plaintiffs do not need to press charges. The state does. The state can also subpoena the plaintiff/witness. I have even seen judges stop proceedings to send sheriffs to pick up a witness that did not want to testify.

If you want YOUR rights protected, and do not trust the police, judge, and prosecution to protect you, then you need an attorney. If you can not hire a private attorney, see a public defender.
