Child Custody from My Sister

My sister has informed me that she is taking me to court to get custody of my disabled son that I allowed her to keep while I was working a way out of a domestic violence situation. She's saying I'm an unfit parent. I left my husband and took my daughter out of state to save her life as well. Then I came to a domestic violence shelter. Followed all rules, job searchs (I have a job now, I found housing for my kids and I'm ready to start my life over in peace. Now this. What are my legal rights? Can she do this?

Your sister can seek "de facto" parent custody in MD and this often occurs in "abandonment" cases. You will have the opportunity to explain the circumstances and demonstrate your fitness at an evidentiary hearing. The child's father would also be a named party and, although there is a preference for the biological parent, this could complicate things if he sided with your sister out of retaliation against you.
