Child Support Help

My Ex-husband does not pay child support on a regular basis. I have a court order where it is to be taken out of his pay but they have not enforced becasue he pays every other month but he is behind by $3,000. They told me the only way to get the attatchment for wages is if I get his work information which I have no access too? PLEASE HELP

Re: Child Support Help

If the child support order includes an earnings withholding order as you indicated, then your ex was and is required to supply current employment information, so that such an order can be put into effect. The earnings withholding order provides for penalties if the paying parent changes jobs and doesn't advise the court of his new employment information.

You should file for a show cause order asking that he be held in contempt and force him to reveal his employment information. The court can also order the employer to withhold an additional amount to pay off the arrearage. An experienced family law attorney can be of great assistance with this.
