It will be difficult to get a divorce as long as you continue to live together as husband and wife. If you want him to leave and if you have evidence of physical abuse of you or your children, or have a reasonable fear that he might abuse you, you could go to court a file for a civil protection order. If that is granted, he would be forced to leave for up to a year. He would also be ordered to pay child support, although it sounds like he has no resources if he isn't working. You should contact the pro bono legal services program through your county bar association to see if you qualify for a free or reduced fee attorney who has experience in this area of law and can more directly assess your situation.
