Legal Question in Family Law in Maryland

grandparents rights/grandchild adopted

My daughter has decided to give up her baby for a semi-open adoption. We want to know if we have any visitation rights to the child.

Re: grandparents rights/grandchild adopted

There is a statute in Maryland that allows

grandparents to petition for visitation. However,

if there is an adoption in the works the fact that

this statute exists would not necessarily mean

you would be granted visitation. The governing rule

is, as always, the best interest of the child. One

of the factors that is to be considered by a court

in such cases is the effect of such visitation on the

nuclear family. If your visitation would be likely

to be disruptive of the new family, then it would

be likely that a court would deny it.
