I need to know if it is illegal for husband to omit me from his medical benefit coverage?

Need more information to answer specifically. Probably not illegal for him not to cover you on his plan. It's usually a choice to cover a spouse.

No, it is not illegal, but it is the type of conduct that is particularly irksome to most judges, because it smacks of vindictiveness. Usually the cost to cover a spouse (particularly if there are children on the plan) is minimal, and it would be much more reasonable for your husband to cover you and ask you to reimburse him for the incremental cost than to leave you without coverage. You don't mention whether you are in divorce proceedings, but if your case is in litigation, the law does give the court discretion to require him to provide coverage for you, at least while the case is pending.
