What rights do I have and how do I execute them if I have been falsely accused of domestic violence?

You are entitled to a hearing which usually takes place a week after the petition is filed by the accuser. At risk is your ability to either continue to live in the premises where the alleged violence occurred, and/or to have contact with the alleged "at risk" parties. If the petition is upheld, you can also be required to financially support the accuser and family if you have been doing so.

These are obviously important rights, and it would be very much in your interest to hire an experienced family attorney to represent you at this hearing. You will need to convince the judge that the charges are groundless and that the accuser is not going to be in jeopardy if the petition is denied. You can bring in witnesses who can back you up if they are available.
