I got a lung infection and went to urgent care on 01/23/2012.The infection has gone all through my body, doctors are keeping me off work until I'm better.I've sent all the information as I get it to my office so as to keep them updated.I'm the service manager and kept up on all my duties via the net and phone, sending the tech's to their jobs. The company owner called me last friday,02/10/2012 and laid me off.My question ,is this legal?

The Family Medical Leave Act requires that most (but not all) employers keep a job open for up to 12 weeks for most (but not all) full-time employees when they are out for medical related conditions. Certain small employers may be exempt from the law, and certain newly hired employees may not be covered.

To find out whether you might have a claim under this law you might want to consult with an attorney who can review the specific facts of your situation with you and analyze possible claims under federal or state law.

While I hope the above post helps it should not substitute for getting legal advice on your specific situation.
