Legal Question in Immigration Law in Maryland

Marrying an Asylee

My girlfriend received her asylum in August (asylum from Burma). We want to marry, the only thing is that in her statement she put that she has a husband that is still back in Burma. She has no intention to bring him over. What, if anything, do we need to do to marry without any legal problems here in the US? I'm a US citizen. Thanks

Re: Marrying an Asylee

She needs to obtain a valid divorce and obtain her divorce decree, so that the two of you are then free to marry each other. The USCIS requires that you submit a bona fide, valid divorce decree as part of your family based immigration petition.
