Legal Question in Employment Law in Maryland

i was let go when i called my employer letting him know i had been released from my doctor to return to work after maturnty leave. the company retained less qualified employees that had less seniority in my position. what are my rights? unfair dismissal? sex descrimination?

Your rights will depend in part on the size of the employer. This is because certain laws protecting pregnancy discrimination and so forth only apply to certain sized employers. Depending on the circumstances, there could be a violation of federal law (Family Medical Leave Act and/or Title VII of the Civil Rights Act) and state law (MD Fair Employment Practices Act) , among other things.

Evaluating a possible discrimination claim is extremely fact specific and an attorney will need to know more details to properly analyze any potential claims. Employment discrimination cases may require a complaint with the EEOC and/or filing suit.
