Legal Question in Personal Injury in Maryland

Auto Damage from Sledding Accident

My 16 year old son slide into a parked car and dented the front right panel, while sledding. what damages are we responsible for and how should it be handled? Should the car owner file a claim with her insurance company? should we just pay for the deductible or for cost to repair the damage? We have filed to claims this year on our home owners insurance (home fire) and do not wish to file another claim for fear of being dropped! Help!

Re: Auto Damage from Sledding Accident

Assuming the person who had parked her car had not done so negligently (if she had parked illegally, for example) she probably could hold you responsible for the damages. Of course, whether she would want to make a claim on her insurance carrier is up to her. If the cost to repair the damage is minimal and if she has a high deductible which the cost to repair is under, her making a claim wouldn't do any good. In short, she could probably hold you responsible for reimbursing her for any of her out-of-pocket loss, whether that is simply her deductible or the entire cost of repair.

A motorist where damage comes upon the insured vehicle from an uninsured source may have to claim against his/her own insurance. A suit may need to be defended for a claim occasioned by a minor. If you should need an attorney for this matter, contact me at (410) 799-9002 and leave a message.
