If you have to file a lawsuit, it must be in NY or in the state where the other driver lives. But first you would file a claim against the other driver's policy, and it would be handled by a claims adjuster. You would be well advised to hire an experienced personal injury attorney who knows how to handle these claims to get you the best possible result. You can certainly use a MD attorney to do this; I've handled many similar claims.
